Introduction This document outlines the policy regarding the use of trademarks I claim rights to.
Nothing herein grants or should be deemed to grant to you any right, title or interest in or to any of the trademarks set out below.
Any use of any methodolagile trademark must be in accordance with this policy. As used in this memo, “trademarks” means not just methodolagile’s logos, but also the names of its various products, as well as the names methodolagile and methodolagile.com. The methodolagile trademarks include, amongst others, the names methodolagile™, methodolagile domains™ and methodolagile.com™, methodolagile.architectfwd.com™ as well as the methodolagile logo, slogans and any other distinctive features. As I register others I will update this policy.
This trademark policy serves the following purposes:
The need to ensure that methodolagile trademarks remain reliable indicators of quality and security, ensure that the trademarks and terms of usage of said trademarks are clear so that my rights to all names and trademarks are not put at risk.
This trademark policy is based on the general law of trademarks.
A trademark is any word, name, symbol, color or sound that is adopted and used by a company to identify its goods and distinguish them from those manufactured or sold by others When a person, user, consumer or any other entity sees the name methodolagile or any related trademark, I want them to be assured that they are dealing with me and therefore are guaranteed of the quality and security that the trademark names represent.
methodolagile trademarks may not be used under any circumstances without my explicit written permission. The trademarks may only be used in projects I am directly involved with and where I have either placed the trademark myself or given explicit written permission for use thereof.
If permission is granted, the following basic guidelines – while not exhaustive - apply:
methodolagile’s trademarks should be used exactly as defined at the top of this document, and should not be abbreviated or modified in any way. The first mention of any trademark must include the unregistered trademark (“™”) after the trademark. A footnote must be included with the text “methodolagile and methodolagile.com [or any trademark above] is a trademark (http://methodolagile.com, https://methodolagile.com, https://methodolagile.architectfwd.com)”
Rules for Proper Usage All names and trademarks are entirely lowercase, MethodolAgile is not allowed, whereas methodolagile or methodolagile.com is correct You may link to methodolagile’s web site but only if you use the link http:// or https://methodolagile.com or https://methodolagile.architectfwd.com. You may not use any logo’s or trademarks without explicit written permission. Do not use logo’s or trademarks on anything, whether it be a physical item or electronic version without explicit written permission. Do not produce modified version of logo’s or trademarks Do not display any trademarks in a way as to imply a relationship or affiliation with methodolagile or methodolagile.com (or methodolagile.architectfwd.com) Do not incorporate any of the trademarks or names into your own company names, logo’s, products or trademarks. Do not register any of the trademarks or names as 2nd or 2+ level domain names Do not use the registration symbol (®). Use only (“™”) until such time as this document reflects permission to do so.
Disputes The venue for any dispute or claim arising out of or in connection with this Agreement shall be in Wellington, New Zealand.
